SELF-DRIVE

  1. To Whom Do These Terms and Conditions Apply?

These terms and conditions will apply to:

  1. You because you are the person who is paying for the rental and any associated costs and you may also be a driver;
  2. Any other driver who is expressly named on the Rental Agreement and who is therefore authorised to drive the Vehicle;
  3. A driver (a “Referred Driver”) named on a Rental Agreement that records the hirer’s name as an insurer, bodyshop, dealership or recovery agency.

  1. Your contract with us

By booking this vehicle, you will have accepted the conditions set out in these Terms and Conditions.

Please read this Agreement carefully. If there is anything you do not understand, please ask any member of staff or email us.

  1. Rental period

You will have the vehicle for the rental period shown in the agreement. We may agree to extend this rental period but the rental period may never be more than 30 days. If you do not bring the vehicle back on time you are breaking the conditions of this agreement. We can charge you for every day or part-day you have the vehicle after you should have returned it to us. Until we get the vehicle back we will charge you the daily rate published on our website.

  1. Your responsibilities
  2. You must look after the vehicle and the keys to the vehicle. You must always lock the vehicle when you are not using it. You must always protect the vehicle against bad weather which can cause damage.
  3. You must not sell, rent or dispose of the vehicle or any of its parts. You must not give anyone any legal rights over the vehicle.

  1. You must not let anyone work on the vehicle without our permission. If we do give you permission, we will only give you a refund if you have a receipt for the work and the work was needed due to no fault of yours.
  2. You must let us know as soon as you become aware of a fault in the vehicle.
  3. You must bring the vehicle back to the place we agreed, during the opening hours displayed at that place. One of our staff must see the vehicle to check that it is in good condition. If we have agreed that you may return the vehicle outside business hours, you will remain responsible for the vehicle and its condition until it is reinspected by a member of staff.
  4. You will have to pay for reasonable costs of repair if:
  • we have to pay extra costs to return the vehicle to its condition when the pre-rental inspection was carried out (for example, if extra valeting time or special material or equipment is needed to restore the vehicle to its pre-rental condition); or
  • you have damaged the inside or outside of the vehicle.
  1. Before you bring back the vehicle you must check that you have not left any personal belongings in the vehicle.
  2. No animals to be transported in cars without prior agreement with EVision.

  1. Our responsibilities

We have maintained the vehicle to at least the manufacturer’s recommended standard. We assure you that the vehicle is roadworthy and suitable for renting at the start of the rental period. Also, if you are not renting the vehicle for business purposes, we are responsible for loss caused by:

  • the vehicle not matching our description of it;
  • the vehicle not being of the quality that you would be entitled to expect from a rental vehicle;
  • the vehicle not being fit to drive; or us not having the legal right to rent out the vehicle;

We are responsible if someone is injured or dies as a result of our negligence, act or failure to act.

We are also responsible for losses you suffer as a result of us breaking this agreement if the losses are a foreseeable consequence of us breaking the agreement.

Losses are foreseeable where they could be contemplated by you and us at the time the vehicle is rented.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of profits or loss of opportunity).

  1. Property

We are only responsible for loss or damage to property left in the vehicle if the loss or damage results from our negligence or a breach of contract.

  1. Conditions for using the vehicle

The vehicle must only be driven by you and any other driver named in the contract, or by anyone else we authorise in writing. Anyone driving the vehicle must have a full valid UK driving licence.

You or any other authorised driver must not:

  • Use the vehicle for hire or reward;
  • Use the vehicle for any illegal purpose;
  • Use the vehicle for racing, pace making, testing the vehicle’s reliability and speed or teaching someone to drive;
  • Use the vehicle while under the influence of alcohol or drugs;
  • Drive the vehicle outside England, Scotland and Wales, unless we have given you written permission;
  • Load the vehicle beyond the manufacturer’s maximum weight;
  • Use the vehicle for towing unless we have given you written permission;
  • Under no circumstances must the remote access be switched off. This is a security device and will invalidate your insurance.

  1. Charges

We work out our charges using our current price list, as published on our website. You will pay the following charges:

  1. The rental and any other charges we work out according to this agreement.
  2. The Deposit which is payable in addition to the cost of the daily rental charge (that you either prepaid at the booking stage or will pay at the time of pick-up).  This Deposit acts as security for any additional charges that may arise during your use of the Vehicle over the Hire Period. This security is in the form of a financial deposit and the amount for this will have been specified in your confirmation email – usually £500. The deposit amount will also be confirmed on the Rental Agreement.
  1. Any charge for loss or damage resulting from you not keeping to condition 4.
  2. We would ask that when collecting a vehicle that you leave a reasonable amount of charge to allow us to get the vehicle back to our office or to a charger for our return journey.
  3. All fines and court costs for parking, traffic or other offences (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. If you do not, you will be responsible to pay our reasonable administration charges which arise when we deal with these matters, in addition to the cost.
  4. The reasonable cost of repairing any extra damage which was not noted on our damage control diagram over the page at the start of the agreement, whether you were at fault or not (depending on 4). And the reasonable cost of replacing the vehicle if it is stolen, depending on any insurance you have (as set out in 8), if and when we demand this payment.
  5. A loss-of-income charge, when we demand it, because it needs to be repaired, it is a write-off (can’t be repaired) or it has been stolen and we are waiting to receive full payment of the vehicle’s value. We will only charge you for loss of income if we can’t get back the losses under the Damage Protection Programme. We will charge you at the published daily rate. We will always do everything we can to make sure the vehicle is repaired or we get payment as soon as possible.
  6. Any charges arising from Customs and Excise seizing the vehicle, together with a loss-of-income charge while we cannot rent out the vehicle, if and when we demand this payment.
  7. Any published rates for delivering and collecting the vehicle.
  8. Interest which we will add every day to any amount you do not pay us on time, at the rate of 2.5% per month.
  9. In the event of the hirer running out of charge and requiring recovery they will remain fully responsible for all costs incurred.
  10. Value added tax and all other taxes on any of the charges listed above, as appropriate.

You are responsible for all charges, even if you have asked someone else to be responsible for them. You can get details of our Damage Protection Programme from our office

  1. Using our motor insurance

Our insurance and excess reduction comes at a separate cost.

If you are using our insurance, we will give you separate information on the insurance cover and any restrictions which may apply. Otherwise, the conditions of our insurance and damage protection programme will apply. By putting your initials in the appropriate box you are accepting the conditions of our insurance and damage protection programme.

We have a legal responsibility to have third party insurance. This provides cover for claims made if you injure or kill anybody, or damage their property (cover for damage to property is limited to £250,000).

We will provide cover for loss or damage to the vehicle if you have ticked the box marked ‘Collision and loss damage waiver’ over the page. If you accept this, you still have to pay an amount up to the ‘responsibility amount’ every time you damage the vehicle.

We will provide cover for theft and damage to the vehicle caused during an attempted theft if you have ticked the box marked ‘Theft waiver’ over the page. If you accept this, you still have to pay an amount up to the ‘responsibility amount’ if the vehicle is stolen. The responsibility amount you have to pay in each case is shown in the contract.

We will provide personal accident insurance, personal belongings insurance and goods in transit insurance if you initialled the appropriate boxes over the page. You can get details of our insurance and damage protection programme (including the main exclusions) from our office.  

We can provide comprehensive insurance for the duration of your rental, up to 30 days. This insurance is valid only in the United Kingdom, unless agreed in writing. Our insurance covers only drivers who we have agreed to insure, and who have provided all of the relevant information, including their driving licence, DVLA driving licence check code (where appropriate), address and identity documents (where requested).

You will have been informed that our insurance policy has an excess of £4,000, meaning that you are responsible for the first £4,000 of any damages or costs. Where the value of damage or insured expenses exceeds £4,000, our insurance will cover this, provided you have complied with the terms set out in this agreement.

We will only insure drivers who meet the below conditions. By signing this rental agreement, you agree that you meet these conditions:

  • You are aged between 25 and 70 years, with the rental starting not before your 25th birthday and not after your 71st birthday.
  • If you hold a UK licence, you have done so for at least three years.
  • If you hold a licence issued by a country other than the UK, you have ensured that this licence entitles you to legally drive the type of vehicle you are renting, in the UK.
  • You have no more than 6 penalty points on your licence, and have fully disclosed any and all penalty points to us.
  • To the best of your knowledge, you have no medical conditions, physical or mental, which could affect your legal entitlement to drive.
  • You have never been refused insurance or had a policy cancelled by your insurer.
  1. Using your own motor insurance

If we fill in the appropriate box over the page you may arrange your own insurance for the full duration of the rental as long as you can prove that this insurance is valid and have signed the confirmation over the page. We have to agree to the amount of cover you arrange, the type of policy and the insurer you have chosen.

We must be satisfied with the cover and policy conditions, and you must not change them. We may ask your insurers to record our name as owners of the vehicle. If the vehicle is damaged or stolen you will let us negotiate with the insurers about whether the vehicle can be repaired or what compensation is due to us. You are financially responsible for settling the full claim and paying all costs if the policy you have arranged fails and the vehicle is damaged, lost or stolen, or a claim as made by any other party.

It is your responsibility to ensure details of all vehicles supplied by us for a period of more than 14 days are entered onto the Motor Insurance Database within 3 days of the vehicle being supplied to you. If we receive any notices or penalties relating to the vehicle being uninsured then we will ask you to pay our reasonable costs for dealing with them.

We will provide cover for theft and damage to the vehicle caused during an attempted theft if you have ticked the box marked ‘Theft waiver’ over the page. If you accept this, you still have to pay an amount up to the ‘responsibility amount’ if the vehicle is stolen. The responsibility amount you have to pay in each case is shown in the contract.

  1. What to do if you have an accident

If you have an accident you must not admit responsibility. You should get the names and addresses of everyone involved, including witnesses. You should also:

  • Make the vehicle secure;
  • Tell the police straight away if anyone is injured or there is a disagreement over who is responsible; and call our office straight away.

You must then fill in our accident report form and email/fax it to our office. Our vehicles may be fitted with telematic devices and your vehicle may be tracked for asset recovery and insurance purpose or in the event of unauthorised usage.

  1. Data Protection

You agree that we may use any information you have given us to carry out our own market research. If you break the agreement we can give this information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. We can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose shown in the Data Protection Act 1998.

  1. Ending the agreement
  2. If you are a consumer we will end this agreement straight away if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may end this agreement if you do not meet the main requirements of this agreement.
  3. If you are a company, we will end this agreement straight away if:
  • You go into liquidation;
  • You call a meeting of creditors;
  • We find out that your goods have been taken away from you until you pay off your debts; or you do not meet any of the conditions of this agreement.

  1. If we end this agreement it will not affect our right to receive any money we are owed under the conditions of this agreement. We can also claim reasonable costs from you if you do not meet the main requirements of this agreement. We can repossess the vehicle (and charge you a reasonable amount) without using unreasonable force or causing damage.

  1. Cancellation and No Show Policy:
  2. If you cancel more than 14 days before the start date of your hire there will be no charge.
  3. If you have to cancel your booking between 2-14 days before the start date, there will be a cancellation fee of 1 day’s rental.
  4. For no shows and cancellation with less than 48 hours’ notice before the start of hire, there is a cancellation fee of of 2 days rental.

  1. Picking Up The Vehicle

15.1 When you pick up the Vehicle from us you will be asked to sign a section on the Rental Agreement that describes the Vehicle’s condition at that particular time. Before you sign the Rental Agreement you should inspect the Vehicle and any accessories for any pre-existing damage.

15.2 If you notice any apparent defect or damage that is not described on the Rental Agreement then you should ensure a note is made on the Rental Agreement and that we both sign the change to it.

15.3 If you don’t notify us of any pre-existing defect or damage then we will assume that you have accepted the Vehicle and any accessories in the condition set out on the Rental Agreement and we will charge you for any new damage that is discovered when the Vehicle and any accessories are inspected by both parties when you return the Vehicle.

  1. Returning The Vehicle

16.1. Return of the Vehicle generally

You should return the Vehicle to the EVision offices on the date and at the time shown on the Rental Agreement. If we are to collect the Vehicle and key from you it must be parked in a suitable place to allow collection at any time up to a period of 8 working hours from the end of the Hire Period without the imposition of any fines or congestion charges.

16.2 Personal Property

We are not responsible for any loss or damage to any personal belongings placed in or on the Vehicle which will at all times be your responsibility. You must not leave any personal belongings in or on the Vehicle when you return it to us (you are responsible for checking and removing your personal belongings from the Vehicle). Any personal belongings left in or on the Vehicle which remain unclaimed 2 months after the end of the Hire Period will be disposed of.

16.3. Early Return

If you return the Vehicle before the return date and time stated on the Rental Agreement then the Hire Period will end when you return the Vehicle to the EVision offices and hand the Vehicle keys to one of our team.

We will not refund any unused prepaid daily rental or accessory charges to you.

16.4 Late Return

We allow you a grace period of 29 minutes after the expiry time and date of the Hire Period shown on the Rental Agreement in which to return the Vehicle to us. If you fail to do so, and you have not extended the Hire Period, then if we do not hear from you for a period of 24 hours concerning the delay in its return we will regard the Vehicle as having been stolen and will report this to the police.

We will take all lawful means to recover the Vehicle (which may include repossessing it or applying for a Court Order requiring you to return it and/or pay us an amount equal to the Vehicle’s market value). If we have to take such steps then:

  • you give us permission (and cannot withdraw it) to access your premises for the purposes of repossessing the Vehicle so long as we do not use unreasonable force or cause damage; and
  • you must pay all our reasonable costs (including any legal or professional costs), charges and fees (including, where applicable, any administration fee or damage administration fee or unauthorised extension fee (as set out in the Tariff Guide).

16.5 Attended check-in of the Vehicle during opening hours

When you return the Vehicle to us you should take the opportunity to:

  • ensure you have removed all of your personal belongings (you are responsible for checking the Vehicle); and
  • inspect the Vehicle together with our team and countersign the check-in document which  includes a record of any new damage (from that described on the Rental Agreement at the time of pick up

You will receive a copy of this signed document.

If, during the inspection, we discover new damage to the Vehicle (from that described on the Rental Agreement at the time of pick up) then we will evaluate it and issue an invoice which you agree we may charge against your insurance Excess amount or Deposit.

  1. Governing law

This agreement is governed by the laws of England. Any dispute may be settled in the courts of England.

 

Gift Voucher Terms & Conditions

Refunds

Refunds can be made on unused vouchers bought directly from EVision within 14 days of purchase.

Refunds can only be made to the purchaser and the monies will be refunded directly to the original method of payment.

Refunds cannot be given on expired, extended or exchanged vouchers.

A voucher purchased through a third party retailer or other resellers will be subject to that retailer’s own refund policy and enquiries must be made directly to them. We cannot refund items purchased from a retailer or other resellers.

To request a refund please send us your voucher along with a covering letter explaining the reason for your request.

 

The “30 Minute Teaser” and The “One Hour Appetiser”

Participant Guidelines:

Minimum age: 25

Maximum age: 70

All drivers need to be in reasonable health

You must hold a full valid UK driving licence which must be produced on the day (no photocopies)

You will not be able to take part in the experience if you have been previously convicted of one of the following:

AC: Accident offence

BA: Disqualified

CD: Careless Driving

DD: Reckless/Dangerous Driving

DR: Drink or Drugs

IN: Insurance Offence

TT99: Disqualification due to maximum penalty points

You will need to provide a credit or debit card for a £500 deposit – payment will be taken approximately 2 days prior to the drive, it is to check that the funds are available. This will be refunded within 5 working days from when the car is returned without damage

 

Please note: anyone deemed to be under the influence of alcohol or drugs will not be permitted to participate  

You are unable to take the car outside mainland UK during your drive

If you wish for an additional driver to be added a fee of £30 will need to be paid at the time of arrival to collect the Tesla.

If you are using our insurance, we will give you separate information on the insurance cover and any restrictions which may apply. Our insurance and excess reduction comes at a separate daily cost, in addition to our daily rate quoted.

Otherwise, we need to be sure that your own insurer has issued satisfactory cover. We will need to see proof of this prior to your hire.

Mileage: No restrictions apply, the open road awaits.

The car must be returned at the specified time. Any late returns will incur a charge

 

Availability

Available Monday to Friday with collection and returns from 09.00 to 15.00 . Date restrictions may apply.

We recommend you book at least four weeks in advance to ensure that dates are available. This is only a guideline and we advise you to book as early as possible to ensure that dates are available before the expiry date listed on your voucher.  All bookings are subject to availability.

 

The “Three Hour Indulgence”

Participant Guidelines:

Minimum age: 25

Maximum age: 70

All drivers need to be in reasonable health

You must hold a full valid UK driving licence which must be produced on the day (no photocopies)

You will not be able to take part in the experience if you have been previously convicted of one of the following:

AC: Accident offence

BA: Disqualified

CD: Careless Driving

DD: Reckless/Dangerous Driving

DR: Drink or Drugs

IN: Insurance Offence

TT99: Disqualification due to maximum penalty points

 

You will need to provide a credit or debit card for a £500 deposit – payment will be taken approximately 2 days prior to the drive, it is to check that the funds are available. This will be refunded within 5 working days from when the car is returned without damage

Please note: anyone deemed to be under the influence of alcohol or drugs will not be permitted to participate  

You are unable to take the car outside mainland UK during your drive

The “24 Hour Unforgettable”

Participant Guidelines:

Minimum age: 25

Maximum age: 70

All drivers need to be in reasonable health

You must hold a full valid UK driving licence which must be produced on the day (no photocopies)

You will not be able to take part in the experience if you have been previously convicted of one of the following:

AC: Accident offence

BA: Disqualified

CD: Careless Driving

DD: Reckless/Dangerous Driving

DR: Drink or Drugs

IN: Insurance Offence

TT99: Disqualification due to maximum penalty points

 

You will need to provide a credit or debit card for a £500 deposit – payment will be taken approximately 2 days prior to the drive, it is to check that the funds are available. This will be refunded within 5 working days from when the car is returned without damage

Participant Guidelines:

Minimum age: 25

Maximum age: 70

All drivers need to be in reasonable health

You must hold a full valid UK driving licence which must be produced on the day (no photocopies)

You will not be able to take part in the experience if you have been previously convicted of one of the following:

AC: Accident offence

BA: Disqualified

CD: Careless Driving

DD: Reckless/Dangerous Driving

DR: Drink or Drugs

IN: Insurance Offence

TT99: Disqualification due to maximum penalty points

 

You will need to provide a credit or debit card for a £500 deposit – payment will be taken approximately 2 days prior to the drive, it is to check that the funds are available. This will be refunded within 5 working days from when the car is returned without damage

Available Friday to Monday, with collection at 15.00 on the Friday and return at 09.00 on the Monday. Date restrictions may apply.

We recommend you book at least four weeks in advance to ensure that dates are available. This is only a guideline and we advise you to book as early as possible to ensure that dates are available before the expiry date listed on your voucher.  All bookings are subject to availability.

Chauffeur Terms & Conditions

Payment and Deposits

Credit card payments are subject to a 1.5% surcharge. Debit cards are subject to a 0.5% surcharge.

All prices are exclusive of VAT charged at 20%.

Our payment terms for all bookings are: 25% deposit with the remaining balance due 7 days prior to the booking. Wedding car balances will be taken 14 days prior to the event.

Your booking may be subject to additional waiting time and car park charges.

The charge on your credit card statement will be shown as H.E. Group Ltd.

Cancellation and Refund Policy

For all cancelled bookings the 25% deposit is non-refundable.

If a booking is cancelled by the Customer within 48 hours from the start of the period of hire, 50% of all monies paid will be non-refundable, see below for wedding bookings.

If a booking is cancelled by the Customer within 24 hours from the start of the period of hire, 100% of all monies paid will be non-refundable, see below for wedding bookings.

If a wedding booking is cancelled within 3 months from the start of the period of hire, the deposit will be non-refundable. If a wedding booking is cancelled within 14 days from the start of the period of hire, the full hire amount will still be charged to the customer.

If the customer does not appear within 15 minutes at the time and place designated as the pickup point, all monies paid will be non-refundable.

Terms of Use (EVision Website)

EVision request a minimum of 12 hours’ notice for any online bookings.

If you would like to book a car with less than 12 hours’ notice – Please call our help-line: +44 (0)208 755 7919.

Whilst we do our utmost to ensure our drivers are punctual, you will understand that we cannot accept responsibility for delays caused by circumstances outside our control.

The driver will drive at safe and sensible speeds in accordance with road conditions, traffic and the legal speed limits.

Clients are responsible for any damage they cause to the interior and or exterior of a vehicle on hire to them and will be billed accordingly for any repair or valeting required in order to reinstate a vehicle to working order.

We may provide subcontracted vehicles occasionally.

By supplying your email address you permit EVision to contact you via email, in return we promise never to supply your email to any third party.

If there are any changes or variations including extra mileage to the journeys other than what was agreed at the time of booking, the client will be charged extras in accordance with the pricing structure on our website.

We reserve the right to change your vehicle or chauffeur at any time if necessary.

Every effort will be made by EVision to ensure that our vehicle(s) or Sub-Contractors vehicle(s) arrive on time.

Our Chauffeur(s) will travel by the most appropriate route on the day, unless instructed otherwise by the Customer at the time of booking including Luxury Airport Transfers.

EVision’s vehicle(s) and sub-contracted vehicles are fully insured for passenger and third party claims. However, customer’s properties are carried entirely at their own risk and EVision shall not be held responsible/liable for any loss/damage to such property.

EVision will keep a lost property book at their office, and will endeavour to return any lost goods left in our vehicle(s) or subcontracted vehicle(s) to the customer.

EVision and its chauffeurs have the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat either to the Chauffeur, the vehicle or any other passenger(s).

EVision maintains a strict non-smoking policy in all its vehicles.

Online quotations do not allow for public and bank holidays like Christmas Day or New Years Eve where there may be an additional surcharge. Please indicate on the quote form if your proposed booking is for a bank holiday or on any other special date.

Nothing contained in these terms and conditions can affect the Client’s’ statutory rights.
